DO HEREBY PROCLAIM :
Article 1
in exercise of the
Short Title This Proclamation may be cited as the
Military Courts Proclamation.
Article 2
Interpretation. In this Proclamation
(1) "Confirming Authority
# means the officer
having the power of confirming a finding sentence
or order of a Military Court.
(2) "Deputy Director" means the Deputy Director
of Civil Affairs in the Legal Branch of the Civil
Affairs Service (Hong Kong).
Article 3
Establishment of a Standing Military Court
(1) All courts and tribunals existing prior to
the establishment of the British Military
Administration shall cease to exercise the juris-
diction and powers vested in them and a Standing
Military Court is hereby established in lieu thereof.
(2) Any Sentence imposed by any such Court or
Tribunal shall, unless such sentence has already
been executed in full, be submitted for confirmation
and dealt with in like manner as if such sentence
had been imposed by the Standing Military Court.
(3) Any case pending or in the course of trial
before any such Court or Tribunal shall forthwith
be submitted to the Deputy Director for decision e8
